Shilpa Shetty and Raj Kundra
Actors Shilpa Shetty Kundra and businessman Raj Kundra have approached the Bombay High Court seeking the quashing of a criminal case filed against them by the Economic Offences Wing (EOW) in the Rs 60-crore cheating case. The writ petitions were filed through their counsel, Advocate Prashant Patil, who is representing the couple in the matter.
According to reports, the case pertains to allegations investigated by the EOW in connection with a financial dispute involving one of Raj Kundra’s business ventures. The couple has sought relief from the court, arguing that the proceedings initiated by the EOW are unjustified and have caused them undue hardship.
The petitions were filed before a division bench of the Bombay High Court, which is expected to hear the matter in the coming days. Advocate Prashant Patil confirmed that the plea seeks to quash the criminal proceedings in their entirety, citing lack of sufficient evidence to substantiate the charges.
What we know about the case?
The case stems from a complaint filed by Deepak Kothari, director of Lotus Capital Financial Services Ltd, a non-banking financial company (NBFC). Kothari alleged that the couple, through an intermediary named Rajesh Arya, approached him in 2015 seeking a business loan.
According to the FIR, a meeting was held at a five-star hotel in Juhu, where Shetty, Kundra, Arya, and Kothari were present. The couple allegedly introduced themselves as directors of Best Deal TV Pvt Ltd, a now-defunct home shopping and online retail venture, and sought financial assistance.
Kothari further claimed that they persuaded him to treat the loan as an “investment” to reduce taxation liabilities, promising regular returns and repayment of the principal amount. He alleged that between 2015 and 2023, a total of ₹60.4 crore was transferred to Best Deal TV’s HDFC Bank accounts.
Last month, Shilpa Shetty withdrew an interim plea seeking permission to travel abroad in October in a separate matter challenging a Look Out Circular (LOC) issued against her and Raj Kundra. She has now sought liberty to approach the court again for permission to travel in December.
Neither Shilpa Shetty nor Raj Kundra has made a public statement on the matter so far. The case is likely to be listed for hearing shortly, following which the court will decide whether the investigation should continue or be set aside.
