The Supreme Court on Friday permitted the disbursal of an additional Rs 5,000 crore from the Sahara Group’s funds, which were deposited with the Securities and Exchange Board of India (SEBI). This decision, which was passed by a bench of Justices Surya Kant and Joymalya Bagchi, aims to expedite the process of repaying depositors in the Sahara Group of Cooperative Societies.
The order comes as a major relief for small-scale investors who have been waiting for years to get their money back. The Supreme Court’s intervention is part of a long-standing legal battle between the Sahara Group and regulatory bodies, centred on the repayment of funds collected from depositors.
The court’s previous orders had mandated the Sahara Group to deposit billions of rupees with SEBI for repayment, a process that has been fraught with challenges and delays. The Solicitor General, Tushar Mehta, who was present during the hearing, played a key role in advocating for the swift and transparent distribution of the funds.
The total amount in the Sahara-SEBI refund account is an estimated Rs 25,000 crore. While some refunds have been made in the past, the process has been slow, leaving millions of depositors in limbo. This fresh disbursal of Rs 5,000 crore is specifically targeted at depositors in the Sahara Group of Cooperative Societies, whose claims will be processed through the Central Registrar of Cooperative Societies.
The Supreme Court has specified that the amount will be repaid on the basis of a report submitted by the Central Registrar, providing a clear roadmap for the repayment process.
