Liability insurance provides financial protection when such risks translate into legal claims or compensation demands.<\/p>\n<p><strong>What does liability insurance mean?<\/strong><\/p>\n<p>Liability insurance helps a hospitality business cover costs if it is held legally responsible for injury, damage, or loss.<\/p>\n<p>\n\u201cFor hospitality businesses in India, the most relevant types of liability insurance typically include a mix of legal liability, customer safety, and operational risk coverage,\u201d said Gautam B Boda, Group Vice Chairman of JB Boda Group.<\/p>\n<p><strong>Key types of liability insurance in hospitality<\/strong><\/p>\n<p><strong>Public liability insurance: <\/strong>Protects against third-party injury, property damage, or death occurring on the premises.<\/p>\n<p>Example: A guest slipping on a wet floor or a falling d\u00e9cor injuring someone.<\/p>\n<p>Boda noted that this can even extend to liability from small expansion projects or from fuel stored on-site for power generation.<\/p>\n<p><strong>Product liability insurance<\/strong><\/p>\n<p>Covers harm caused by products served, such as contaminated food or beverages.<\/p>\n<p>\u201cIt is recommended that food contamination and product recall expenses are also covered under this policy,\u201d added Boda.<\/p>\n<p><strong>Commercial general liability (CGL) insurance<\/strong><\/p>\n<p>Combines public and product liability and sometimes advertising liability.<\/p>\n<p>\u201cAccidents like bodily injury, property damage, and even food poisoning can happen anytime. CGL ensures that the hotel is financially protected while keeping the brand reputation safe,\u201d explained Evaa Saiwal, Head of Liability &amp; Cyber Insurance at Policybazaar for Business.<\/p>\n<p><strong>Employer\u2019s liability\/workers\u2019 compensation insurance<\/strong><\/p>\n<p>Required under the Employees\u2019 Compensation Act, 1923.<\/p>\n<p>Saiwal said this cover is critical as \u201chotels rely heavily on staff in kitchens, housekeeping, and maintenance, and this ensures employers can provide compensation without facing financial strain.\u201d<\/p>\n<p><strong>Professional indemnity insurance<\/strong><\/p>\n<p>Covers claims from professional errors, such as mismanagement of an event or wrong advice from staff.<\/p>\n<p><strong>Liquor liability insurance (where applicable)<\/strong><\/p>\n<p>Relevant for properties serving alcohol, protecting them if intoxicated guests cause harm.<\/p>\n<p><strong>Cyber liability insurance<\/strong><br \/>&#13;\n<\/p>\n<p>\nProtects against data breaches, ransomware, and cyberattacks.<\/p>\n<p>\u201cHotels majorly operate on digital platforms and a cyberattack or customer data breach can lead to massive financial and reputational damage,\u201d said Saiwal.<\/p>\n<p><strong>Directors &amp; officers (D&amp;O) liability insurance<\/strong><\/p>\n<p>Shields management from personal liability over business decisions or alleged mismanagement.<\/p>\n<p><strong>Event liability insurance<\/strong><\/p>\n<p>Short-term cover for weddings, conferences, or corporate events.<\/p>\n<p>Example: An accident at a corporate offsite or property damage during a large function.<\/p>\n<p><strong>How are premiums calculated?<\/strong><\/p>\n<p>Insurers factor in property type, size, business turnover, occupancy, facilities, and past claims to determine premiums. Saiwal noted that \u201cthe presence of swimming pools, banquet halls, or bars can raise premiums, as these increase risk exposure.\u201d<\/p>\n<p>Boda added that in India, premiums are paid upfront and adjusted later based on actual turnover and payroll.<\/p>\n<p>Most liability policies include a &#8216;duty to defend&#8217; clause, where insurers assist businesses in responding to liability notices.<\/p>\n<p><strong>Guest expectations and risk coverage<\/strong><\/p>\n<p>Risk management is increasingly shaped by guest expectations.<\/p>\n<p>Tarun Gulati, Director, Ganga Kinare Resorts &amp; Hotels, observed, \u201cGuests now place a strong emphasis on safety, transparency, and accountability. Reputation protection comes from both effective coverage and swift resolution of guest concerns,\u201d she said.<\/p>\n<p>Dhanani added that Sayaji Hotels views liability insurance as part of a larger trust-building exercise with guests. \u201cToday, guests expect transparency, clarity in safety processes, and assurance that their well-being is prioritised.
