While the wife\u2019s notice has been quashed, the husband\u2019s case remains pending.<\/p>\n<h3>Understand The Full Case<\/h3>\n<p id=\"4\" class=\"story_para_4\">According to the court order dated August 4, 2025, the wife\u2019s name was added to the property documents purely for convenience. Bank statements confirmed the husband paid the entire amount from his HDFC Bank account, as <em>per ET Wealth report<\/em>.<\/p>\n<p id=\"5\" class=\"story_para_5\">The court cited its earlier decision in Kalpita Arun Lanjekar vs. ITO (2024), where a similar notice to a non-contributing joint owner was cancelled.<\/p>\n<p id=\"6\" class=\"story_para_6\">Justice B.P. Colabawalla and Justice Firdosh P. Pooniwalla noted that no income had escaped assessment in the wife\u2019s case and that all payment details were traceable to her husband. They questioned why the Assessing Officer targeted her despite clear evidence.<\/p>\n<p id=\"7\" class=\"story_para_7\">Experts told <em>ET Wealth<\/em> Online that joint property ownership can raise red flags for tax authorities if not documented properly.<\/p>\n<p id=\"8\" class=\"story_para_8\">Chartered Accountant Dr. Suresh Surana told <em>ET Wealth<\/em> the purchase deed should record each co-owner\u2019s financial contribution and ownership percentage.
