Maggi Vs Maggisun Case:<\/strong> The Delhi High Court has closed a trademark infringement lawsuit filed by Nestl\u00e9 SA, the parent company of the popular instant noodle brand Maggi, after the FMCG giant reached a settlement with the defendant.<\/p>\n

The case, which was originally filed in 2018 by Societe Des Produits Nestl\u00e9 SA, was against Shankeshwar Utensils & Appliances Pvt. Ltd., which had been manufacturing utensils under the brand name \u201cMaggisun.” Nestl\u00e9 argued that the name was deceptively similar to its iconic Maggi trademark.<\/p>\n

Justice Tejas Karia decreed the suit on September 22 after the defendant agreed to discontinue the use of the \u201cMaggisun” name or any other mark resembling \u201cMaggi.”<\/p>\n

In its order, the court stated that the suit was decreed in terms of the settlement arrived at between the parties and directed both parties to abide by the terms of the settlement. The court also disposed of all pending applications in the case.<\/p>\n

As part of the settlement, Shankeshwar Utensils acknowledged Nestl\u00e9 as the rightful owner of the Maggi trademark. The company undertook not to manufacture, sell, advertise, or promote products under \u201cMaggisun” or any similar name across any platform, including print, electronic, social media, or e-commerce. It also agreed to destroy all products, stickers, and labels bearing the \u201cMaggisun” name and submit photographic evidence to Nestl\u00e9 within two weeks. Additionally, the company committed to cancel its trademark registration for the \u201cMaggisun” brand.<\/p>\n

Nestl\u00e9, in turn, agreed not to pursue its remaining claims as long as the settlement terms were honoured. The resolution brings an end to a legal dispute that had been ongoing for nearly seven years.<\/p>\n
