Delhi HC Signals \u2018No Room For Non Disclosure In Family Disputes\u2019 In Sunjay Kapur Inheritance Case<\/p>\n<\/figure>\n

Sunjay Kapur\u2019s inheritance case has been grabbing headlines for a long time. In a fresh update, the Delhi High Court on Friday orally said that it will not pass an order for a \u201cconfidentiality club” after the counsels agreed not to disclose the contents of the list of assets and information regarding the case to the media. Priya Kapur\u2019s earlier demand for a non-disclosure agreement (NDA) binding Sunjay Kapur\u2019s second wife\u2019s children, Samaira and Kiaan, would not be entertained.<\/p>\n

Justice Jyoti Singh expressed strong reservations on Thursday, saying such an order \u201cmay be problematic” because it could deprive the children of their right to question disclosures. \u201cHow will you file a written reply and argue cases if everything is in sealed cover?” she asked. \u201cIf they are bound by confidentiality, how will they ever defend their case?”<\/p>\n

By Friday, Priya Kapur had stepped back from her NDA push, agreeing to sealed cover submissions instead, a mechanism that shields sensitive documents from public scrutiny while allowing access to the parties involved. For Samaira and Kiaan, it means they won\u2019t be restricted by contractual secrecy, preserving their ability to verify and challenge the Will. The duo, who have challenged the legitimacy of the will and accused Priya Kapur of wiping clean Sunjay Kapur\u2019s bank accounts, termed it a \u201cbogus Will”.<\/p>\n

Justice Singh ordered that an inventory of Sunjay Kapur\u2019s movable and immovable properties be submitted to the court and shared with his mother Rani Kapur and his children from his first marriage. While directing that these disclosures not be made public, the court firmly disapproved of Priya\u2019s request for an NDA.<\/p>\n

\u201cThe court emphasised that heirs have an unquestionable right to know the details of an estate they may be entitled to. They have no issues disclosing the assets. All that was said, let this not be made public. You have the right to know,” Justice Singh noted.<\/p>\n

Senior advocate Mahesh Jethmalani, representing Samaira and Kiaan, stressed in court, \u201cAccording to this patently bogus will, I have been deprived of everything. Two accounts have been wiped clean and 6% share has been appropriated. For me, there is nothing confidential. What is there to hide?”<\/p>\n

Karisma Kapoor And Sanjay Kapur<\/strong><\/p>\n

Karisma Kapoor married Sunjay Kapur in September 2003. The couple became parents to their daughter, Samaira, in 2005 and their son, Kiaan, in 2011. However, they parted ways in 2016. Kapur passed away in June 2025. While Karisma is not directly involved in the legal battle of her former husband\u2019s inheritance drama, she is representing her children, Samaira and Kiaan. The two moved to the Delhi High Court recently to demand a share in the assets of their late father. In their petition, the two children claimed that their stepmother, Priya Sachdev, forged Sunjay\u2019s will. They submitted that the purported will allegedly executed by their father is not a legal and valid document, is forged and fabricated.<\/p>\n

They argued that it is because of this reason that neither the original of the Alleged Purported Will has been shown to them nor a copy of the Alleged Purported Will has been provided. The children, therefore, previously requested the court to provide them with a copy of the said document.<\/p>\n
